The Site provides real estate listing data (sourced from the applicable MLS), an AI-powered assistant, market analysis and CMA reports, and communication tools (chat, SMS, email). All such information is for general informational purposes only, is not guaranteed accurate or complete, and is not a substitute for professional, legal, or financial advice. Verify independently before relying on it. Standard message and data rates may apply to SMS.
Real estate services are provided by Bethany Klier. Any representation agreements, purchase contracts, or other legal documents are between you and the licensed real estate professional and/or brokerage. Bethany Klier is solely responsible for compliance with real estate, advertising, fair housing, and communications laws (including the TCPA and CAN-SPAM Act).
Site content is owned by or licensed to us and may not be copied or redistributed without consent. MLS listing data is licensed for personal, non-commercial use to identify prospective properties and may not be reproduced or redistributed. By submitting content (reviews, photos, messages), you grant us a non-exclusive, royalty-free license to use it in connection with the Site.
You agree not to use the Site unlawfully; violate fair housing laws; scrape or extract data; reproduce MLS data; interfere with or attempt unauthorized access to the Site; transmit malware; send spam in violation of the TCPA/CAN-SPAM Act; impersonate others; or misuse AI features to generate harmful or illegal content.
THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant the accuracy of listing data, valuations, CMA reports, or AI-generated content, and are not responsible for third-party services or other users' conduct.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BETHANY KLIER, CHATREALTY AND JPS & COMPANY LLC, OR THEIR OFFICERS, EMPLOYEES, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID IN THE PRECEDING 12 MONTHS OR ONE HUNDRED DOLLARS ($100).
You agree to indemnify, defend, and hold harmless Bethany Klier, ChatRealty and JPS & Company LLC, and their respective officers, employees, and affiliates, from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms or applicable law, or your content.
These Terms are governed by the laws of the State of California. Before any formal proceeding, you agree to first attempt informal resolution for 30 days. Disputes will be resolved through binding individual arbitration (JAMS Streamlined Rules), except small-claims matters. YOU AND WE WAIVE ANY RIGHT TO A CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
By using the Site you consent to receive electronic communications (email, SMS, push notifications, in-app messages), which satisfy any legal writing requirement. You may opt out of non-essential communications as described in the Privacy Policy and the SMS terms below.
If any provision is unenforceable, it will be modified or severed and the rest remains in effect. These Terms, the Privacy Policy, and any agreements you enter with us constitute the entire agreement regarding the Site.
